1) Purpose
a) Policy: petdirect.co.nz Limited (We, Us, Our) privacy policy (Privacy Policy) applies to all visitors to and users of this website [https://www.petdirect.co.nz] (the Website) and should be read in conjunction with the Standard Terms and Conditions.
We respect your privacy rights and are committed to protecting and dealing with these rights in accordance with the Privacy Act 2020 (Privacy Act). This Privacy Policy does not limit or exclude any of your rights under the Privacy Act.
b) Purpose: The purpose of this Privacy Policy is to let visitors and users of the Website know when we collect personal information and what we do with it. We do not use, share or transfer personal information except as set out in this Privacy Policy (or otherwise as permitted or required by law). When we talk about “Personal Information”, we are referring to personal information as defined in the Privacy Act, being any information about an identifiable individual.
c) Defined terms: Where a defined term is used in this Privacy Policy but that term is not defined in this Privacy Policy, then such term will have the meaning given to it in the Standard Terms and Conditions.
2) Collection of Personal Information
a) No disclosure required: The Website can be viewed without the need for you to provide any personally identifiable information to us.
b) Types of information we may collect: We may collect the following types of Personal Information from your use of the Website:
- Personal Information provided by you at the time of subscribing as a Member or using he website as a User, which includes, but is not limited to, your name, address, delivery instructions, phone number, email address, information regarding your pet (including, but not limited to, your pet’s name, medical information, age, breed, activity level, weight, daily food intake and preferences), credit card and Afterpay information/payment details, and any other such Personal Information that you provide to us through your dealings with us; and
- Non-identifiable information: other forms of non-personally identifiable information, such as aggregate technical information, which tracks traffic to the Website, which includes, but is not limited to, your device identifier, server address, IP address, domain (whether you are accessing the Website from New Zealand or elsewhere), the platform you are using, browsers used when accessing the Website (including version), users’ search terms, pages accessed on the Website, links that are clicked on, date and time of Website visits, users’ operating systems, and any other such technical information relating to your use of the Website.
c) Sources of Personal Information collection: We may collect Personal Information from the following sources:
- you, by filling in the registration form when you subscribe as a Member;
- through your use of and interaction with the Website, mobile app, or devices / forms in our Stores,
- through your interaction with our administrators, such as by telephone, email, webchat or with staff at our Stores;
- through cookies and Google analytics; and
- provided by third parties authorised by you.
d) Services unavailable: Failure to provide necessary Personal Information when requested may result in certain services on this Website, Affiliated Websites or in Store not being available to you.
e) Changes: Members are able to access and change their details (name, email address, password, and credit card information) as part of their Subscription details.
3) Disclosure of your Personal Information
a) Disclosure: We will not disclose Personal Information we hold about you to any third party except as set out in this clause 3.
b) Service Providers: We work with third-party service providers who provide hosting, maintenance, backup, storage, infrastructure, payment processing, logistics and delivery, analysis, marketing and other services for us, which may require them to access information about you Some of these service providers may be located in countries outside of New Zealand. If any at time we need to send Personal Information outside of New Zealand, we will ensure that existing contractual relationships are in place, or otherwise enter into a binding contractual relationship with an overseas party confirming that it will protect Personal Information in a way that provides comparable safeguards to those provided under the Privacy Act.
c) Employees and related companies: Our employees assess and recommend a meal plan for your pet and the frequency of ordering and delivery of the Products based on the meal plan, which may require them to access information about you.
d) Legal Obligations: In exceptional circumstances, we may share information about you with Government and other regulatory authorities, where authorised or required by law.
e) Sale of our business: In the event that we propose to sell the business or any of our assets, we may provide your Personal Information as part of a database to a prospective buyer solely so that they can consider the purchase of the business. Should we proceed to sell the business (or a material part of it) we may provide your Personal Information as part of that sale so that the purchaser can continue to operate the business and contact you about their plans for the business.
4) Use of your Personal Information: We may process and use the Personal Information we collect for the following purposes, and where necessary for or directly related to these purposes:
(a) to contact you as necessary including:
- to enable you to access and use our Website or utilise Member features in Stores;
- obtain feedback on a Product you have ordered;
- send periodic emails you have subscribed to through your nominated email address or mobile text / app messages;
- as part of the transaction process when you order a Product from our Website or Store.
- respond to any queries and/or comments you have sent to us; and
- to investigate any complaints relating to the misuse of the Website or its functionality;
(b) to allow us to administer and manage your access to our Website, including verifying your identity and assisting you if you forget your user ID and/or password;
(c) to assist in prepopulating certain information in various forms that may need to be completed when you transact with us using the Website and Affiliated Websites;
(d) to assist in providing the Subscription to you, including to allow us to process payments in respect of your Subscription – you will have the option to choose to allow us to store your credit card or other payment account information by checking the “Remember details for next time” checkbox at the time of payment. If you elect not to store your credit card or other payment account information you will need to resubmit this information for each purchase made from the Website;
(e) to monitor, develop and improve the Website and ensure that content on the Website is relevant, of interest to you and presented in the most effective manner for you;
(f) to update and maintain our records, including details of people that have accessed our systems;
(g) we may, from time to time, anonymise data and use it in a manner in which you cannot be identified so we can understand how our Website is used and the types of Products that are being purchased;
(h) for any other purpose authorised by you, or the Privacy Act; and
(i) to protect and/or enforce our legal rights and interests, including defending any claim.
5) Linking and third-party websites
a) Linked sites: The contents of the Website may include links to other third-party websites (Linked Sites). The Linked Sites are provided to you as a convenience and/or a courtesy, and the inclusion of any link does not imply our endorsement of the Linked Sites or any association by us with their business or owners. We are not responsible for the data protection/privacy/cookie usage policies of any Linked Sites and those sites may not follow the same privacy policies as us. We recommend that you check any relevant privacy policies of such Linked Sites before providing your Personal Information to any third party.
6) Opting in and Opting Out:
a) Changes: If our intended collection, use or disclosure of your Personal Information is outside the collection, use or disclosure set out in this Privacy Policy we will inform you and give you the option to:
(a) opt out and not receive certain services or participate in certain interactive areas; or
(b) opt in to agree to be contacted by us in relation to certain matters such as notification of new features to the Website and promotional activities.
b) Unsubscribing from marketing and promotional material: You may opt out of receiving marketing and promotional materials from us by utilising the unsubscribe function in communications sent to you. Any emails we send will also always contain a link at the bottom enabling you to edit your email settings, be removed from our general mailing list, or where you are a Member you can unsubscribe as part of your Subscription details.
7) Retention of Personal Information
We will retain your Personal Information for as long as it is required for the purpose/s for which it was collected, or otherwise as required by law.
In most cases, once Personal Information is no longer required, we will securely destroy it or otherwise delete all identifying details so that only anonymised data is retained.
8) Accessing and correcting Personal Information
We take all reasonable steps to ensure that the Personal Information we hold is accurate, up to date, complete, relevant, and not misleading.

9) Mandatory reporting of notifiable privacy breaches
If your Personal Information is involved in a privacy breach which we reasonably believe is notifiable or must be reported in accordance with the Privacy Act (“Notifiable Privacy Breach”), we will inform the affected individual/s and report the Notifiable Privacy Breach to the New Zealand Office of the Privacy Commissioner.
10) Changes to Privacy Policy
We reserve the right to change this Privacy Policy (Amendments) at any time. Any Amendments will be posted on this page on the Website and the “last updated” date will be updated.
